* Between “5D Academy” (represented by Sole Proprietor Ruslan Kolesnikov, hereinafter referred to as the “Academy”) and the Partner.
A person who accepts this public Offer by registering in the affiliate program of the “5D Academy” project (hereinafter referred to as the “Academy”) on the website www.academy5d.com becomes a Partner of the Academy under the following terms:
- SUBJECT OF THE AGREEMENT
1.1. The Partner, by размещing an affiliate link received during registration in the Academy’s Affiliate Program on their social media, websites, blogs, or other informational resources, attracts customers interested in purchasing educational courses and консультації offered by the Academy on the website www.academy5d.com (hereinafter referred to as the “Information Product”). Customer acquisition may also be carried out through lawful email campaigns containing the affiliate link.
1.2. The Academy pays the Partner a commission.
- RIGHTS AND OBLIGATIONS OF THE PARTIES
2.1. The Academy undertakes the following obligations:
2.1.1. Ensure proper functioning of the website www.academy5d.com.
2.1.2. Register the Partner in the Affiliate Program, provide an affiliate link, and assign a unique Partner identification code.
2.1.3. Track referrals from the Partner’s resources to the Academy’s website and monitor actual sales generated from such referrals.
2.1.4. Pay the Partner commission in accordance with Section 3 of this Agreement.
2.1.5. Provide консультації regarding the operation of the website and necessary information for fulfilling the Partner’s obligations. Support and explanations related to the Affiliate Program are provided via email (info@academy5d.com).
2.1.6. The Academy has the right to require the Partner to stop any actions that may mislead customers or potential customers regarding the nature of the Information Products.
2.1.7. Terminate this Agreement without paying commission if the Partner violates clauses 2.2.5 – 2.2.8.
2.1.8. The Academy may terminate this Agreement if no sales have been generated via the Partner’s link within 6 months.
2.2. The Partner undertakes the following obligations:
2.2.1. Attract audience from their online resources to the Academy’s Information Products.
2.2.2. Include the assigned Partner identification code in the HTML code of their resources. Failure to do so will result in no tracking and no commission payout.
2.2.3. Immediately inform the Academy of any issues or errors related to affiliate links.
2.2.4. Not send unsolicited emails or messages (spam is strictly prohibited).
2.2.5. Not place affiliate materials on third-party websites without permission.
2.2.6. Not create excessive load on the Academy’s website through artificial traffic or manipulation.
2.2.7. Refrain from illegal activities or actions that could harm the Academy’s reputation or involve it in legal disputes.
2.2.8. Not use affiliate links to purchase products for personal use.
- PARTNER COMMISSION AND PAYMENTS
3.1. The Partner receives commission for fully paid purchases made via their affiliate link.
3.2. Commission is calculated based on purchases made within 365 days from the first subscription or order.
3.3. The Partner receives 10% of each purchase made via their affiliate link.
3.4. Custom terms may be agreed upon for Partners with an audience of 500,000+ followers.
3.5. The Academy provides real-time earnings data in the Partner’s personal account.
3.6. Payments are made monthly (1st–10th) via bank transfer. Bank fees are covered by the Partner.
3.7. The Partner may use earned commission to purchase Academy products.
- SPECIAL CONDITIONS
4.1. Actions performed in the Partner account are legally binding and equivalent to a signature.
4.2. Email communication is legally valid and equivalent to signed documents.
4.3. The Partner must provide signed documents within 5 business days upon request.
4.4. The Partner must notify the Academy of any changes in their details.
4.5. Providing false information may result in termination without payout.
4.6. Violation leads to termination and ban from re-registration.
4.7. False registration data results in permanent removal from the program.
4.8. Prohibited content includes illegal, violent, discriminatory, or adult content.
4.9. The Partner bears full responsibility for any damages.
4.10. The Academy may change pricing and access conditions at any time.
- FORCE MAJEURE
5.1. Parties are not liable for failure due to force majeure circumstances.
5.2. The affected party must notify the other within 3 business days.
- DISPUTE RESOLUTION
6.1. Disputes are resolved through negotiations.
- TERM OF THE AGREEMENT
7.1. The Agreement is valid for 1 year from acceptance and auto-renews unless terminated.
7.2. The Academy may terminate at any time with payment of accrued commission.
- OTHER TERMS
8.1. Rights and obligations cannot be transferred without written consent.
8.2. The Academy may update this Agreement at any time by publishing a new version.
8.3. Communication is conducted via email.
